Gardeners Haringey Service Terms and Conditions

These Terms and Conditions set out the basis on which Gardeners Haringey provides gardening and related services to residential and commercial clients in its service area. By booking, accepting a quotation, or allowing work to commence, you agree to be bound by these Terms and Conditions. If you do not agree, you must not use our services.

Definitions

In these Terms and Conditions, the following expressions have the meanings set out below.

Client means the person, company or organisation booking or receiving the services.

Services means any gardening, garden maintenance, clearance, landscaping, planting, lawn care, hedge cutting, pruning, tidy-up, or related work provided by Gardeners Haringey.

Agreement means the contract between Gardeners Haringey and the Client incorporating these Terms and Conditions and any written quotation or confirmation.

Visit means a single attendance at the property to provide services, whether as a one-off or as part of a recurring schedule.

Scope of Services

Gardeners Haringey provides general gardening and garden maintenance services, including but not limited to lawn mowing, hedge trimming, pruning, weeding, planting, tidying, soil preparation, seasonal maintenance, garden clearance, and minor landscaping works as agreed in advance.

The exact scope of work for any Visit will be agreed with the Client prior to commencement, either verbally or in writing, based on the quotation or booking confirmation. Any additional work requested on site that falls outside the agreed scope may be charged separately and is subject to availability of time, materials, and personnel.

Booking Process

Bookings may be made by the Client through our accepted communication channels. When making a booking, the Client must provide accurate information about the property, access, parking, garden size, and the type of services required.

Gardeners Haringey may provide an estimate or quotation based on the information supplied. For certain jobs, a site visit may be required before a final quotation is issued. Quotations are normally valid for a limited period, which will be stated when the quotation is provided.

A booking is considered provisional until confirmed by Gardeners Haringey. Confirmation may be given in writing or through a clear verbal agreement of date, time, and scope of work. Gardeners Haringey reserves the right to decline any booking at its discretion.

For recurring services, such as regular garden maintenance, the Client agrees that visits may follow a recurring schedule. Any changes to a recurring booking should be requested with reasonable notice.

Access, Parking and Site Conditions

The Client is responsible for ensuring that Gardeners Haringey has safe and reasonable access to the garden or outdoor area at the agreed time, including access through any communal areas if relevant. If access is not available or is significantly delayed due to the Client, Gardeners Haringey may charge a call-out or wasted visit fee.

The Client should ensure that the work area is reasonably clear of obstructions, hazardous materials, pet waste, and personal items. Gardeners Haringey is not responsible for moving heavy furniture, large obstacles, or personal property unless this has been expressly agreed in advance.

Where parking restrictions or charges apply, the Client must either provide suitable parking or cover any parking costs incurred by Gardeners Haringey in attending the property. Any such costs may be added to the final invoice.

Pricing, Estimates and Quotations

Services may be charged on an hourly, daily, per-job, or fixed-price basis, as set out in the quotation or booking confirmation. All prices are provided in pounds sterling and may be subject to applicable taxes, which will be clearly stated where relevant.

Any time-based pricing will be rounded to the nearest reasonable unit as declared at the time of booking. If work takes longer than originally estimated due to unforeseen circumstances or inaccurate information supplied by the Client, additional charges may apply, subject to agreement on site.

Estimates are provided as a guide only and are not binding. Fixed quotations, where given, will be based on the information and conditions known at the time. Gardeners Haringey reserves the right to amend a quotation if the scope of work changes or if unforeseen issues arise, such as hidden waste, access difficulties, or safety concerns.

Payments and Invoicing

Payment terms will be stated at the time of booking or quotation. Unless otherwise agreed, payment is due on completion of the services for one-off visits, and for recurring maintenance it may be due per visit or at agreed intervals.

Accepted payment methods will be confirmed to the Client and may include bank transfer or approved electronic methods. Cash payments are accepted only where expressly agreed and must be accompanied by an invoice or receipt.

For larger projects or landscaping work, Gardeners Haringey may require a deposit before commencement. The amount and timing of any deposit will be stated in the quotation. Work may be paused or cancelled if deposits or interim payments are not received when due.

If payment is not made by the due date, Gardeners Haringey reserves the right to charge interest on the overdue amount at a reasonable rate, as well as any administrative fees incurred in pursuing payment. Continued non-payment may result in suspension or termination of services and may be referred to a third-party collection agency if necessary.

Cancellations and Rescheduling

The Client may cancel or reschedule a Visit by giving reasonable notice. Unless otherwise stated in writing, a minimum of 24 hours notice before the scheduled start time is required for standard visits.

If the Client cancels or requests to reschedule with less than the required notice, Gardeners Haringey may charge a late cancellation fee, up to a reasonable proportion of the expected cost of the Visit, to cover lost time and scheduling costs.

In cases of persistent last-minute cancellations or missed appointments, Gardeners Haringey may require prepayment for future bookings or may choose to discontinue services.

Gardeners Haringey reserves the right to cancel or reschedule a Visit due to reasons including severe weather, staff illness, safety concerns, access problems, or other circumstances beyond its control. In such cases, any prepayments for the affected Visit will be applied to a rescheduled appointment or, if rescheduling is not possible, refunded for that Visit only.

Weather and Seasonal Conditions

Certain services may be affected by weather or seasonal conditions, for example heavy rain, high winds, frozen ground, or extreme heat. Gardeners Haringey will use reasonable judgment to determine whether work can be carried out safely and to a suitable standard in the prevailing conditions.

If a Visit cannot proceed as planned due to adverse weather, Gardeners Haringey will seek to reschedule the appointment. The Client accepts that some delays may be unavoidable for safety and quality reasons and that plant growth, lawn appearance, and other outcomes can be influenced by conditions outside our control.

Client Obligations and Responsibilities

The Client must provide accurate information about the garden, existing features, and any known hazards. The Client should notify Gardeners Haringey of any underground services, cables, pipes, or other hidden features that may be affected by digging or other work.

The Client is responsible for securing pets and ensuring that children and other occupants do not interfere with tools, machinery, or work areas during a Visit. Gardeners Haringey is not liable for any incident arising from failure to keep pets or children away from active work areas.

Where the Client supplies plants, materials, or equipment, these remain the Client's responsibility. Gardeners Haringey accepts no liability for defects or failures in materials or plants supplied by the Client.

Quality of Service and Complaints

Gardeners Haringey aims to deliver services with reasonable skill and care. If the Client is dissatisfied with any aspect of the services, they should raise the issue promptly, ideally within 48 hours of the Visit, providing details and any supporting evidence.

Gardeners Haringey will investigate complaints and, where appropriate, may offer to revisit the property to address any reasonable concerns in relation to the original scope of work. Any remedial work is at the discretion of Gardeners Haringey and does not constitute an admission of liability.

Garden Waste and Environmental Regulations

Gardeners Haringey will manage garden waste in accordance with applicable UK environmental and waste management regulations. The default position is that green waste generated during normal gardening, such as grass cuttings, leaves, prunings, and small branches, will be left on site in a designated area or placed in the Client's garden waste bin, unless otherwise agreed.

If the Client requires removal and disposal of garden waste, this must be agreed in advance and may incur additional charges to cover labour, transport, and disposal fees. Certain types of waste, such as soil, rubble, large logs, or contaminated materials, may be subject to higher charges or may not be accepted for removal.

The Client is responsible for ensuring that any waste left in their bins meets local council collection rules. Gardeners Haringey is not responsible for any refusal by the local authority to collect waste placed in the Client's bins.

Liability and Limitations

Nothing in these Terms and Conditions shall limit or exclude liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be excluded under UK law.

Subject to the above, Gardeners Haringey will not be liable for any indirect or consequential loss, loss of profits, loss of business, or loss of opportunity arising out of or in connection with the services provided.

Gardeners Haringey will take reasonable care to avoid damage to property while working. However, the Client acknowledges that minor damage or disturbance to plants, lawns, borders, surfaces, or fixtures may occur as part of normal gardening activities. Gardeners Haringey is not liable for normal wear, tear, or disturbance that is inherent in the nature of the services.

Where damage occurs directly due to negligence, Gardeners Haringey may, at its discretion, repair the damage, replace the affected item with something of similar value, or offer reasonable financial compensation. Any claim for damage must be notified to Gardeners Haringey as soon as reasonably possible and in any event within 7 days of the Visit.

Health and Safety

Gardeners Haringey operates with regard to relevant UK health and safety laws and best practices. Staff may refuse to carry out any work they consider unsafe, impractical, or outside their training or equipment capabilities.

The Client must not request services that would involve unsafe working at height, use of unsuitable equipment, or removal of materials that present health risks. Where necessary, Gardeners Haringey may recommend specialist contractors for certain tasks.

Property, Plants and Natural Variations

Gardens are living environments, and the success of plants, lawns, and landscaping features can be affected by soil conditions, weather, pests, diseases, wildlife, and ongoing maintenance by the Client. Gardeners Haringey cannot guarantee specific results such as growth rates, flowering times, or plant survival, except where expressly agreed in writing.

Advice on aftercare and maintenance may be given, but it is the Client's responsibility to follow any instructions regarding watering, feeding, pruning, and general care. Gardeners Haringey is not liable for deterioration of the garden or plants where recommended aftercare has not been followed.

Termination of Services

Either party may terminate an ongoing maintenance arrangement by giving reasonable notice, usually not less than 14 days, unless a different notice period has been agreed in writing.

Gardeners Haringey may terminate services immediately where the Client fails to pay sums when due, behaves abusively toward staff, creates unsafe working conditions, or otherwise breaches these Terms and Conditions in a serious or persistent manner.

On termination, the Client remains liable for all work completed and costs incurred up to the date of termination. Any outstanding balances become immediately due.

Changes to Terms and Conditions

Gardeners Haringey may update these Terms and Conditions from time to time to reflect changes in law, operational practices, or service offerings. The latest version will apply to all new bookings from the date of publication. For ongoing maintenance arrangements, the Client will be deemed to accept updated terms by continuing to use the services after being informed of the changes.

Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the services provided, shall be governed by and construed in accordance with the laws of England and Wales.

The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.

Severability

If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable by a court or competent authority, such provision shall be deemed deleted, but this shall not affect the validity and enforceability of the remaining provisions.

Entire Agreement

These Terms and Conditions, together with any quotation, written confirmation, or agreed specification, constitute the entire agreement between Gardeners Haringey and the Client in relation to the services and supersede any prior discussions, correspondence, or understandings.

By booking or continuing to use the services of Gardeners Haringey, the Client confirms that they have read, understood, and agree to these Terms and Conditions.
